PETA's charity status questioned

An organization that tracks crimes against business interests filed a complaint yesterday asking the Internal Revenue Service to revoke the tax-exempt status of People for the Ethical Treatment of Animals.

The 12-page complaint, filed by Ron Arnold, executive vice president of the nonprofit Center for the Defense of Free Enterprise (CDFE), argues that the Norfolk-based animal rights group should be stripped of its charitable status. The complaint says PETA supports domestic terrorist groups, steals trade secrets and assaults business executives.
"PETA is required by law to be operated exclusively for the charitable purpose of prevention of cruelty to animals," the complaint says. "PETA's pattern of encouraging unlawful activity goes back more than 10 years. Its activities are completely inconsistent with its allegedly charitable purpose."
The complaint accuses PETA of acting as a "conduit for information" for the Animal Liberation Front (ALF), which was singled out in congressional testimony by the FBI regarding domestic terrorism last month as "one of the most active extremist elements in the United States."
It also claims PETA funds were used in the legal defense funds of one ALF member who pleaded guilty in 1995 to destroying a University of Michigan laboratory conducting animal tests.
The complaint recounts several episodes where PETA members were arrested during protests for stunts ranging from slashing leather clothes in a New York store to setting a fire on the steps of the U.S. Capitol to protest government plans to help the pork industry.
"I don't think the average person realizes PETA's a tax-exempt organization," said Alan Gottlieb, president of the Bellevue, Wash.-based CDFE. He said the real offense is that U.S. taxpayers are subsidizing PETA's activities by permitting PETA donors to deduct contributions as charitable contributions on their income tax returns.
PETA founder and Executive Director Ingrid Newkirk yesterday characterized the complaint as "one half-truth linked to another half-truth with a dollop of misstatement."
"It didn't look like anything new," she said. "Some of it is highly offensive."
Miss Newkirk said the issue continues to be one of free speech.
"It's not a crime to say what you think," she said. "Otherwise we would have been locked up."
But she acknowledged that the loss of tax-exempt status could be devastating for her organization, which drew more than $13 million in donations for the tax year ending July 31, 2001.
"Anytime an organization loses its tax-exempt status, there are some donors who will give less or not at all," she said, adding that was the center's true goal.
Miss Newkirk also accused the center of preying on post-September 11 fears about domestic terrorism.
During congressional testimony before the Committee on Resources subcommittee on forests and forest health probing the increasing threat of ecoterrorism on national forest lands, PETA general counsel Jeffrey S. Kerr acknowledged the organization's "sometimes creative and theatrical means of communicating our message in a tabloid era."
But Mr. Kerr testified that "PETA has never engaged in violence or threats of violence against any person or entity, no matter how heinous their animal abuse."
The chairman of that subcommittee, Rep. Scott McInnis, Colorado Republican, yesterday sent a letter to Miss Newkirk independently of the center's complaint to the IRS asking her to clarify PETA's relationship with the Earth Liberation Front (ELF), ALF's sister organization.
"As a nonprofit organization with tax-exempt privileges and the incumbent public policy obligations that status entails, PETA has a responsibility to explain the full extent of its involvement with and contributions to environmental terror groups like ELF and ALF," Mr. McInnis wrote.
An IRS spokesman yesterday couldn't confirm that the center's complaint had been received but said auditors do conduct investigations that are based on information received from outside sources.
Still, he said, federal tax law would preclude him from confirming or denying whether an investigation into PETA's tax-exempt status was under way.

Ten Somalis living in Minnesota were deported to Somalia in February, and five more face possible deportation to their devastated homeland.

None of the 15 has been accused of any connection to terrorism, but the deportations are part of the Justice Department's post-Sept. 11 crackdown on illegal immigrants, especially those from countries that the U.S. government suspects of having ties to terrorist organizations.

"One thing Sept. 11 showed us is that we need to have a better grip who's in our country and why," said U.S. Attorney Tom Heffelfinger.

Heffelfinger's office is coordinating an operation by the FBI and Immigration and Naturalization Service to locate illegal immigrants.

Tim Counts, a spokesman for the INS office in Bloomington, confirmed that a chartered plane took 30 Somali deportees -- 10 from Minnesota -- to Mogadishu, the Somali capital, on Feb. 14.

Heffelfinger and INS officials said they wanted to reassure law-abiding Somalis that they had nothing to fear. All of those deported or in custody had violated a deportation order or had been convicted of a crime that made them subject to deportation.

Eight of the 10 deportees had been taken into custody from 1999 through January 2002 for offenses ranging from sex crimes to drug offenses to assault, he said. The other two did not have criminal records but had been found by a judge to have entered the United States illegally.

"We are really concerned about what's happening," said Osman Sahardeed, assistant director of the Somali Community of Minnesota. "We are wondering if this is lawful" and are fearful about the fate of the deportees. Decades of conflict between competing warlords have created chaos and danger in Somalia.

Deportees "are hunkered down in a Mogadishu hotel in fear for their lives because locals believe they are U.S. agents," Sahardeed said. "Most of these people don't come from Mogadishu. Who is taking the responsibility if something happens to them?"

He said there are also questions about their treatment by INS officials, including being shackled and denied access to lawyers and phone calls to family. "What we're hearing is that their families were not aware of their deportations," Sahardeed said. "They found out when they got the calls from Mogadishu, so where is the due process?

Counts, the INS spokesman, said it is standard procedure to shackle deportees en route to their native countries for security reasons. And although the Somalis had no access to lawyers or telephones after Feb. 11 -- while on their way first to Buffalo, N.Y. and then to Somalia -- they were not prevented from calling anyone before they left the state.

Although exact numbers are not known, Minnesota is probably home to more than 10,000 Somalis, most of whom arrived during the 1990s while their homeland descended into anarchy. There is no functioning government in the country, and various territories are controlled by a variety of warlords. A Transitional National Government has been formed to try to reunify the country, but it controls only part of the capital and none of the countryside.

In the aftermath of Sept. 11, U.S. officials have speculated publicly that the lack of a central authority in Somalia might make it an appealing place for fleeing Al-Qaida leaders.

The U.S. government accused a Somali Islamic organization, Al Itihaad al-Islamiya, and a large Somali money transfer firm, Al-Barakaat, of having ties to Al-Qaida. For a while in December, Somalia was thought to be a leading candidate for U.S. military action, although such speculation has faded more recently.

Somalis in Minnesota were distressed about the shutdown of Al-Barakaat, which many of them used to send money to families in Somalia, a country without a functioning banking system.

They also complained that the allegations of Al-Qaida connections to Somalia had subjected them to hostility in Minnesota. Word of the deportations set off a new round of fears.

Bill Strassberger, spokesman for the INS in Washington, noted that the agency routinely deports immigrants who commit crimes and had shipped Somalis home before Sept. 11.

Said Heffelfinger: "The Somalis who have been deported or detained violated the law, and we are simply enforcing the law." The FBI and the INS were not using any new laws, Heffelfinger said, but in the post-Sept. 11 environment "there's no doubt that the INS is aggressively enforcing laws that are on the books."

The Justice Department has created a program called the Absconders Project to locate people who are in the United States despite existing deportation orders. The INS has a list of more than 300,000 foreigners whom it would like to locate and question.

"In order to prioritize within that number," Heffelfinger said, "the INS has focused on people from countries with ties to Al-Qaida or other organized terrorist activity." In the case of Minnesota, which may have the largest Somali population of any state, this has led to a focus on Somalis who meet the program's criteria.

Nice, Steve. I read this article this morning and I was pleasantly surprised until I started reading about Ali Abdala Basamafuck's statements. The typical whining of a minority who doesn't realize what he's got until it's gone. I just sighed, and said to myself, "Should I post this on noncompliance, or will someone else?" Happily, I saw that Mike jumped the gun, and I couldn't wait to see the Cramer response. I don't even need to say antything after that one, nor would I feel the need. I just wish people like Al Khabed Your Mommajamma would be able to read posts like that because then they would know how a true MINORITY feels. What minority? The straight, middle class, white kind. The kind that never gets listened to, the kind that NEVER pulls the racism/sexism/religiosism/any ism/mambi pambi little bitch use anything for an excuse as to why you're fucked up in the head card. Boston Drops Lawsuit Against Gun Industry

BOSTON — The city of Boston, citing financial concerns and improved weapon safety measures, has dropped its lawsuit against the gun industry.


The city sued gun manufacturers, distributors and trade groups in June 1999, alleging they were responsible for gun violence. The suit sought to recover the costs of gun-related violence.

Sixteen similar suits are pending involving 25 other cities. Boston's case was expected to be the first to go to trial, in September.

Mayor Thomas M. Menino said Wednesday the suit was withdrawn after both sides agreed to a plan that calls for the industry to devote more resources to combating gun violence in Boston.

He also said going to trial was too expensive.

According to the city's top health official, John Auerbach, the city was spending $30,000 per month during the discovery phase of the case. He could not give the total amount spent.

"Under extreme pressure from our suit and others like it, the industry is starting to take small steps to address our concerns of safety and education," the mayor said. "We're not there yet, but it's a move in the right direction."

The mayor cited new state regulations that mandate all firearms meet minimum design and safety standards, and the gun industry's decision to include free locking devices with each firearm.

Dennis Henigan, legal director of the Washington-based Brady Center to Prevent Gun Violence, which helps litigate the suits, said no other city has voluntarily dropped its suit.

"It is a very sad day, but I think Boston is encouraging other cities to carry on, and we think they will," he said Wednesday.

There have been 21 similar suits in recent years, Henigan said. Courts have dismissed cases brought by New Orleans, Miami, Bridgeport, Connecticut, and Camden County, New Jersey.

Five other suits have been dismissed, but are being appealed, he said. Jersey City, New Jersey, planned to sue the industry on Thursday, Henigan said.

Boston's suit named 31 defendants, including manufacturers Taurus International and Glock.

Gun rights proponents applauded Wednesday's decision to drop the case.

"It indicates they should have never brought the lawsuit to begin with," said James Baker, the National Rifle Association's chief lobbyist. "It's a lesson that other cities ought to take. Criminals are responsible for their own actions, not manufacturers of legal products."

Spokespersons for Glock and Taurus International could not be reached for comment after business hours Thursday.

There were 28,874 gun-related deaths in the United States in 1999, the most recent statistics available from the Centers for Disease Control and Prevention.

Please alert your friends to this alarming threat. We must ban doctors before this gets out of hand. As a Public Health Measure, I have withheld the statistics on lawyers for fear that the shock could cause people to seek medical aid.

It's amazing what one has to belive to, belive in gun control.

That guns are the real cause of crime, but we will blame and jail the owner of said gun for the crime, even if the owner wasn't the person involved.

That a mugger will kill you in the half-second it takes to draw from the holster, but won't harm you while you dial 911 on your cell phone, talk to the dispatcher and wait half an hour for the cops to arrive.

That gun control works, which is why there are no illegal weapons in Northern Ireland or Beirut.

That the Second Amendment only applies to flintlocks, just as the First Amendment only applies to quills and lead type.

That the proper response to an attack is to call the police, but only unarmed police, because "Violence never settles anything."

That it's wrong to make snide, sexist comments about women, unless the comments are about women who own guns.

That a gun with an 11 round magazine is dangerous, but a gun with fifteen 10 round magazines is much safer.

That a hijacker could easily take a gun away from a pilot, but the hundreds of passengers aboard would then be unable to take the gun away from the hijacker.

That if there'd been a gun aboard American Airlines Flight 11, someone could have been hurt.

That rapists prefer to attack armed women so they can take the guns and use them against the victims.

That the laws against specifically named weapons have been found unconstitutional, that the laws against "types" of weapons have been considered vague, that the laws against cosmetic features are easy to comply with and still produce the identical mechanism, and that laws against particular mechanisms are unconstitutional is an indication of the "obsessiveness" of firearms enthusiasts to do what they enjoy doing, against the wishes of the narrow minded prudes who wish to stop them, and not an indication of the obsessiveness of the ignorant paranoids who fear them.

That NASA, the military, physiologists, anatomists and trainers all agree and Olympic scores confirm that men on average have tremendously more upper body strength than women, but women should try to defend themselves with martial arts and not a gun.

That it's terrible when police officers plant weapons on a suspect to enable them to make an arrest, but we should have tougher laws against weapons and trust the police not to abuse them in this way.

That police arriving at 80mph are a better way to stop criminals than bullets arriving at 800mph.

That people buy guns as "substitute penises," because they know that only people with small penises ever get attacked by criminals.

That it's wrong to politicize that the World Trade Center attackers didn't need guns to hijack a plane, but okay to politicize that the Columbine killers bought guns…illegally.

That when someone dies because they couldn't get a drug the government won't approve, it's tragic, but when someone dies because they couldn't defend themselves with a gun the government won't approve, that's just life.

That a criminal is somehow more of a threat to a cop than to a regular person, so police need guns and regular citizens don't.

That the "Reasonable" uses for guns are hunting and target shooting, but not self-defense. In other words, it's acceptable to use them as toys but not as lifesaving devices.

That .50 caliber rifles are both "very rare" and "selling like hotcakes."

That the fact that .50 caliber rifles are very rare justifies banning them, just as the rarity of Lamborghinis and other high-performance cars justifies banning them.

That one has the moral obligation to make a citizen's arrest when one sees a felony in progress, and that it should be accomplished by yelling at the perpetrator, "Stop! Or I'll yell 'stop' again!" rather than by drawing a weapon.

That intelligent people should support gun control because they realize they are too stupid to be trusted with guns.

That a gun is merely an inadequate substitute for a penis, so when attacked by a mugger one should pull out a…

That a gun is a symbolic penis…what this has to do with defending one's life I have no idea. It simply serves to prove that anti-defense psychiatrists clearly have Freudian issues that THEY need to address.

That reasonable licensing fees will stop casual ownership of guns, but anyone who would jump through hoops to own a gun is obsessive.

That outlawing the carrying of guns will stop people from doing so, just as lowering the speed limit stops reckless driving.

That there is no left-wing conspiracy to send police and troops to imprison American gun owners, but there is a vast, right-wing conspiracy of gun owners who must be disarmed for attempting to stop it.

That .50 caliber weapons must be banned in case Americans use them to shoot holes in the armored cars that the government doesn't own and isn't going to send against them.

That ships using Australian waters mustn't carry handguns against the mythical threat of piracy or mutiny, because some aspiring captain might sell them for a few bucks.

That gang punks shot by other gang punks are innocent victims, and babies shot by government agents deserve to die because of the unpopular beliefs of their parents.

That allowing the poor and minorities to defend themselves is Fascist.

That small arms can't win wars, as all the Viet Cong bombing, air superiority, and naval missions prove.

That John Wayne, rejected by the Marines for bad knees, who portrayed firearms as used by soldiers and law enforcement is a draft-dodging agent of evil, but antigun draft dodger Sylvester Stallone, making movies about Vietnam veterans and using weapons gratuitously, is an American hero to be slobbered over.

That violence is bad, but any defensive use of a firearm that doesn't involve the death of the perpetrator is invalid.

That the NRA is bad for running political activities, but the Million Moron March, stealing money from AIDS research, illegally maintaining tax-exempt status as a 501c(3) organization and fraudulently using a hospital rent-free as its headquarters is good for running political activities.

That Charlton Heston is evil for working for the NRA for free, but Sarah Brady charging $10,000 a speech is a paragon of altruism.

That a ranch rifle made after 1994 is somehow a military rifle.

That all firearms retailers are illegal gun dealers, just like all pharmacists are illegal drug dealers.

That hate is not a family value, but all gun owners are tobacco-chawin', beer-swillin', racist, redneck bubbas.

That a gun which sits silently in a drawer and costs pennies per round to shoot is a bad idea for self defense, but a dog that requires walks, veterinary care, and licenses, may not be allowed in certain neighborhoods and may annoy the neighbors at all hours is a good idea for self defense.

That the worst thing one can do if there's an intruder in the house is get a gun and apprehend them, and the best thing on can do is pretend to be asleep and wait for them to go away, especially if they are raping your children.

That gun control will "keep guns out of the wrong hands," meaning law-abiding Americans' hands.

That trigger locks do not interfere with the ability to use a gun for defensive purposes, which is why it makes sense that police officers are exempt from using them on their duty weapons.

That the government attempting to stop the Microsoft "monopoly" is good, and the Federal government pressuring cities to buy guns only from Smith & Wesson is also good, and not monopolistic.

That "assault weapons" have no purpose other than to kill large numbers of people, which is why the police need them.

That "assault weapons" are only designed for killing offensively, and the police need them but you do not.

That citizens don't need to carry a gun for personal protection but desk-bound police administrators who work in a building filled with cops do, as do tax auditors, vegetable inspectors, mail inspectors, and meat inspectors.

That beer-gutted police have special mental, emotional and physical capabilities that enable them to deal with the incredible complexity of a firearm, and private citizens can never hope to achieve such competence.

That the Brady Act and the "Assault Weapons" Ban which both went into effect in 1994 are responsible for the decrease in violent crime rates since 1991.

That 25% of the dealers at gun shows are unlicensed, and we must license these purveyors of books, tools, knives, clothing, artwork, candy and historical artifacts.

That because of New York's "tough laws" against guns, there exist black market dealers who spend thousands of dollars in gas and other expenses to drive to Arizona, which has "weak laws" in order to buy Ruger pistols at $500 each retail and drive back to New York and sell them to criminals at an "average" of $50 each, thereby making a profit.

That there's no contradiction in the same liberals who said in the 60s that 18 year olds who could fight should be able to vote, now saying that 18 year olds can vote but shouldn't own guns.

Not real crazy about the way this one is phrased, because i belive that police are trained very well and have more aquired compitence than the rest of us.

I was out grinding my Glock 30 today at Bill's.

They have a Mark 23 there with a four fingered flash suppressor, 5 - 10 rd mags, and a camo colored case like my HK case for $2000. Time to spend next years tax return.....
